"Table talks" have long been a familiar genre of writing for jurists, theologians, politicians, and novelists. In this little volume, leading law and religion scholar John Witte offers thirty sage reflections on how to thrive in law school and in the legal profession; short commentaries on controversial matters of faith, freedom, and family; pithy sermons on difficult biblical texts about law and justice; and touching tributes to a few of his fallen heroes. Restorative Justice was a term and concept largely unused before the mid-1970s. Wayne Northey happened to be in on the ground floor of facilitating its worldwide adoption as a challenge to Western retributive justice systems, ultimately to violent responses to conflict domestically and internationally. The most replicated early model of Restorative Justice, based on the well-known ""Elmira Case, "" was a Canadian first, initially dubbed Victim Offender Reconciliation Project (VORP). The author became its second director in 1977. The term ""mediation"" later displaced the more religious word, ""reconciliation, "" as the model spread outside Christian moorings; and ""program"" displaced the initially more tentative ""project."" At seminary, Northey had learned to think through one's vocation theologically. He began in that vein, writing and publishing on this profound call for a systemic ""paradigm shift, "" and has been at it ever since. "It's an open secret that voters in smaller, less populous states have more electoral power than their urban counterparts, so why are these same voters the most eager to leave behind democratic principles? In this book, political scientists Thomas Schaller and Paul Waldman explore why, with all of this extra influence, these same voters fail to see real benefits, for instance suffering worse health and education outcomes than larger states, and why they are the most likely to rage against the democratic project the moment elections stop going their way. This is the patriotic paradox of rural America: The rural citizens who take such pride in their patriotism are least likely to defend core American principles, even when the system itself is set up in their favor. This book critically analyses the availability of environmental counterclaims in investment arbitration presented by the respondent host state against the claimant investor. It starts from the premise that the conflicting relation between investment law and environmental protection cannot always be avoided. Yet, the instrument of environmental counterclaims in investment arbitration might alleviate such relation. Throughout its chapters, this book addresses the questions about the societal and practical relevance of seeking redress for environmental damage in investment arbitration, the functioning of such instrument both in contract-based and treaty-based investment arbitration, the suitability of arbitral tribunals to rule upon environmental issues, and the kind of environmental damages that could be redressed. Most importantly, by deconstructing the requirements of jurisdiction, connection between main claim and counterclaim, and cause of action, this book provides the tools for the re-conceptualisation of the instrument of counterclaims with the hope of harnessing its utility to achieve appropriate redress for environmental damages caused by foreign investors

"This comparative philosophy of law book aims at formulating a new analytical approach to the Islamic legal tradition based on juridical categories, a concept that facilitates comprehension and understanding of juridical phenomena. "This book seeks the moral roots of America's antidrug regime and debunks claims early antidrug laws arose from racial animus. The moral roots trace to early Christian sexual strictures. Augustine condemned sex as indulging beastly appetites and suspending Godlike reason. The demands of procreation excuse indulgence but only as necessary. Puritans similarly condemned drunkenness as suspending reason and rendering persons bestial. Yet alcohol too was deemed necessary-as a foodstuff, sanitary beverage, and pain and cold remedy. One could use alcohol as necessary, never to intoxicate. Saint Thomas Aquinas defined temperance, drinking in moderation, as a moral safe harbor. These principles largely defined temperance debates in England and America, helping make and unmake England's eighteenth-century gin ban and American national prohibition. The regime that followed embraced alcohol's social necessity, permitting drinking in moderation. Other drugs can't easily strike this moral balance. Nineteenth-century Chinese opium dens served no apparent need and seemed to allow no subintoxicating use. Worse opium was thought a sexual stimulant, ruining respectable young women. Hence lawmakers banned opium dens and later cocaine and cannabis. Lawmakers distinguished necessary medical use from recreational abuse by criminalizing sales unless prescribed. Early antidrug laws rarely rose from racial strife. They sprang from the traditional moral censure of intoxication and perceived threats to respectable white women and youth. Today's drug war's racial dynamic differs greatly. One of the steps in criminal procedure deals with the role of the courts, executive, and administrative agencies in granting pardons and paroles to the tens of thousands of prisoners each year. Constitutional provisions can be found in both the Federal and State constitutions for executive clemency through pardon and/or parole by the President and/or governors as part of their constitutional powers. Presidents and governors have used their clemency authority throughout the history of the country. Every state contains both statutes and regulations dealing with pardon/parole. The statutes provide law for pardon and parole, but it is administrative agencies (agencies, boards, commissions) that actually draw up the regulations for the procedures of carrying out pardons and paroles.
